Booking Terms and Conditions

The properties on this website are offered for self-catering on a weekly basis, Saturday to Saturday (4pm on the day of arrival to 10am on the day of departure) unless otherwise stated, and subject to the following terms and conditions.

  1. The contract of booking is made when My Holiday Scotland have received a signed booking form, your booking details, the non-refundable, reservation deposit of £150, and we have confirmed the booking to you. Please make cheques payable to “My Holiday Scotland,” If you are booking a holiday 8 weeks prior to the commencement of your holiday, payment must be made in full on booking.
  2. It is assumed that the Hirer has read and agreed to abide by these terms and conditions. Once that contract is made, the Hirer becomes liable for the full balance of rental charges. These are payable 8 weeks prior to commencement of the holiday.
    Non-payment of the balance of hire charges by the due date, will result in us treating the property as being available for re-booking.
  3. .If the hirer cancels a confirmed booking they remain liable for the full cost of the holiday. Upon receipt of written confirmation of the cancellation from the hirer, we will endeavour to re-let the property and if successful will make a full refund to that hirer less an administration fee of £50, and any other expenses incurred in re-letting. Therefore we recommend that you take out holiday cancellation insurance.
  4. My Holiday Scotland will treat a booking as cancelled (see above) if the balance of the payment is not received by the period specified in the booking agreement (8 weeks prior to arrival date). Every effort will be made to re-let the property and a refund given.
  5. A Good Housekeeping Deposit of £50 will be asked for prior to the commencement of each holiday. This is returnable to the hirer less the cost of making good any damage or loss to the property, or for the excessive cleaning found necessary following the period of occupation. It is a condition of the let that the hirer leaves the property and the contents clean and tidy.
  6. The contract effected between the hirer and the owner of the property is in terms of Schedule 4 Section 8 of the Housing (Scotland) Act 1988 and confers on the hirer the right to occupy the property for the period agreed for holiday purposes only.
  7. The hirer shall not sub-let the premises or any part thereof.
  8. The number of persons occupying a property must not exceed the maximum occupancy level stated without prior consent of the owner. Owners reserve the right to terminate the occupancy of the property without notice or refund in the case of a breach of this condition.
  9. The hirer binds and is obliged to vacate the hired premises without demand at termination of the hire.
  10. Any pets the hirer intends to bring on holiday should be checked with, and authorized by the owners of the properties.
  11. The hirer is responsible for the condition of the property and its entire contents during the hire period, fair wear and tear excepted. The hirer will make good any damage or loss and leave the property and contents in clean and tidy conditions. The person held to be responsible for the hiring party will be the person who made the booking.
  12. In the event of My Holiday Scotland being prevented, because of circumstances beyond their control (eg fire damage, drought or the interruption of utility supplies) from putting the property at the disposal of the hirer, the hire charges shall be refunded in full, but the hirer will have no further claim against the owner.
  13. My Holiday Scotland reserves the right to refuse to hand over properties to any person or persons who in their opinion is not suitable to take charge. In such cases hire charges shall be refunded in full and the liability of the owner shall cease.
  14. .It is important to My Holiday Scotland that hirers enjoy their holiday, and we will make effort to enable this. However, in the unlikely event of dissatisfaction with the property the hirer must contact the owner, caretaker/keyholder immediately so that the opportunity to rectify the problem is given. Under no circumstances will any refunds be considered if the property owner/caretaker has not been given the opportunity to rectify any of the problems during the hirer’s let.
  15. Any specific conditions and restrictions applying to certain properties (restrictions on pets, young children etc) will be mentioned in individual property descriptions, and will be deemed to form part of these terms and conditions.
  16. The Hirer shall undertake to prevent members of the their party from causing a disturbance or nuisance to other residents or occupiers.
  17. The Hirer undertakes to leave the holiday property secure if left unoccupied during a period of let.
  18. The Hirer undertakes to permit the owners and agents reasonable access to the property.
  19. My Holiday Scotland, their agents or employees, accept no responsibility for loss, injury, or damage to the Hirer’s party or their property, however caused, arising in any manner out of the let of the premises.
  20. For arrivals far outside the normal arrival hours, a modest fee of £15 will be incurred for unsociable hours.
  21. We have compiled the information on our website as accurately as possible at the time of going to press. Mistakes may occur from time to time. The hirer must accept that minor differences between information of the website and the actual properties may arise. If a facility is particularly important to you, please check with us prior to booking.
